Police discovered the dead body of Raphael Sanchez wrapped in cellophane and stuffed into a large, black plastic storage container in a Flatlands home on East 54th Street on Saturday.

Joshua Simser, 24, has been charged with the murder of  Sanchez. The accused lives at 1561 East 54th Street, where the body was found.

According to the Daily News, the murder was the result of Sanchez smoking a cigarette in Simser’s residence despite the host’s wishes.

Cops arrested Joshua Simser, 24, who allegedly had a spat with Raphael Sanchez, over smoking Saturday inside his home on E. 54th St. in Flatlands.

Simser is charged with murder. He stabbed Sanchez several times before tying him up and dumping him in the bin, cops said.

CBS local reported that the authorities first received a tip from a Brooklyn nightclub owner who said that a “bouncer at the club admitted to the owner that he’d killed a man.”

Police then arrived at the two-family brick home where they found the body. Emergency workers pronounced Sanchez dead at the scene.

Simser was arrested on Sunday and was charged with second-degree murder.

      Even if second-hand smoke does not kill, it is very uncomfortable for some like those who have asthma. I was always constantly coughing since I was eight whenever around someone who was smoking. When I was in college I was forced to sit next to elope who were smoking in class? How could someone learn while he is feeling sick because of the smoke. At least people don’t have to suffer silently any longer. You can smoke all you want in private but not in confined areas. I also think banning smoking in parks is ridiculous.

      If I remember correctly the stats, there are about 2,000 deaths a year in NYC from second hand smoke. Chances are you are one of those partially responsible for one or more of those deaths. Hope you’re ok with that.

        Right, the “stats” — based on scientific malpractice and the media’s lack of will to print anything to the contrary.

        For instance, it was only a few months ago that an article on a soon-to-be published study was printed. Headlined “No Clear Link Between Passive Smoking and Lung Cancer” in the Journal of the National Cancer Institute, the available abstract says, “A large prospective cohort study of more than 76,000 women… found no link between [lung cancer] and secondhand smoke.”

        Buy the full paper and there you’ll find Dr. Gerard Silvestri adding, “We’ve gotten smoking out of bars and restaurants on the basis of the fact that you don’t want to die. The reality is, we probably won’t.”

    He had probably felt that he was defending himself against the hazards of second hand smoking. Let us remember that second hand smoke kills. There was an old case when someone had used the twinky defense. I am sure that this guy will find someone to defend him successfully. He should call Storobin. I wonder if Storobin has had anyone come through the doors of three of his fancy offices, since he lost the city council election to Chaim
