NYC Department of Health has confirmed that no qualified educational or teacher director was on site at Royal Crown Day Care during any of the agency’s twelve inspections, dating back as far as December 2009. A qualified educational director is a requirement for operating a day care center in New York City, and they’re in charge of activity and educational planning and leading the educational staff.

Educational directors must be registered with the DOH, and the agency indicated that Royal Crown had employed one on paper but that the employee was never on the scene. DOH could not comment further as it is an ongoing investigation.

Royal Crown’s attorney, S. John Bate Esq., said that it was all a mix up due to “some confusion.”

According to Bate, Royal Crown hired someone and submitted paperwork, but the woman never showed up and wasn’t on the payroll. Because of that, an Aisha Okoro was “slotted temporarily to do that role,” but it appears Okoro may have been unqualified.

Royal Crown Pre-School Academy and Day Care Center was closed on June 15 when the DOH revoked its permit after finding 14 staff members lacked required clearances and four teachers lacked required qualifications, in addition to the missing on-site educational director. The Department also found Royal Crown Day Care to be packing students into rooms and exceeding capacity, while not meeting the required staff-to-child ratios.

Bate will be heading to New York State Supreme Court tomorrow to seek reinstatement of Royal Crown’s permit, pending reviews of the violations that he said will clear the business’ name.

“Months will go by” before the review process begins, he said. “There will be a loss of business, a loss of money, a loss of jobs, not to mention parents need their kids taken care of … I don’t see why there can’t be compliance time.”

He intends to show that the DOH violations aren’t sufficient reason to justify closure, the agency did not give enough time to rectify the problems, and closure is causing undue financial burden that may put Royal Crown out of business forever.

Most of the violations were paperwork-related, and some were even errors inspectors made during the eight-hour visits, Bate said. The lack of clearances, for example, is because the fingerprints have been sent to Albany for review, but the agency takes time to return them and there are “provisions” to employ the workers in the meantime.

“It takes a while,” he said. “It’s not unusual and there are ways to deal with that.”

Moreover, he said the child-instructor ratio was just two over the limit.

“Where’s the danger to safety? Where’s the danger to health? Where’s the danger to the children they’re trying to protect?” Bate asked. “It just doesnt seem right or fair.”

Bate added that the business was not given enough time to rectify the violations, though the DOH is required to give two weeks to a month on certain violations and 24 hours on others. But he said Royal Crown’s owners were originally told during their June 14 inspection that they had until July to fix the problems. Staff members were surprised when the DOH turned up the next day and closed down the facility.

Owners of Royal Crown Day Care and Bate believe that the DOH’s heavy-handedness have little to do with children’s safety, but are retribution for complaints made about the agency’s practices. Even before the day care opened, Royal Crown received calls from competitors who warned that they’d be shut down by the DOH. After opening, DOH paid several visits, but they received no violations. The agency is required to respond to any and all complaints.

Feeling harassed, owner Boris Rey fired off a letter to State Senator Marty Golden’s office. The letter complained about inspectors’ attitudes and treatment of his employees, and also the agency’s willingness to play into his competitors’ tactics. Golden’s office forwarded the letter to the DOH, a move which Bate said brought the agency’s anger against his client.

“I’m not saying Mr. Rey is an angel, but whatever they’re trying to prove here isn’t to do with the operation of the day care, it’s something else,” he said.

“They complained about the way the DOH treated them, and instead on getting help from Golden’s office they handed it over to the DOH who read it and responded, “Oh, okay, we’re going to fix you now,” Bate said.

Golden’s office rebutted allegations that the case was handled inappropriately by saying they followed procedure.

“When a resident or community organization contact Senator Golden’s office for assistance with a New York City or State agency, it is the policy of the staff to contact the necessary or appropriate agency in an effort to be of assistance in resolving the matter,” said John Quaglione, a spokesperson for Senator Golden. “Such is the case in this matter which was brought to our attention by the Royal Crown Day Care.”

Until those issues are sorted out, Bate is moving to get Royal Crown’s 18 employees back to work. He’s prepared a packet that includes supportive letters from parents, DOH’s documents, photos of the interior and exterior conditions of the school and more to sway Supreme Court decision-makers into reinstating Royal Crown’s permit until their DOH hearing date.

“Clearly we’re the underdog here in terms of the authority and power and influence in comparison to the DOH,” he said. “I’m just trying to level the playing field a little bit.”

    No, it's Golden. Sheepshead Bay is split between Kruger and Golden, though Kruger represents the majority of it. Golden has a narrow strip – at some points (including this one) one block wide – that connects his Bay Ridge stronghold with Marine Park and Gerritsen Beach.     Holy freaking Gaga, you're kidding me, right? “JUST TWO” children over the ratio means a BIG difference in safety!! It IS a danger to have too many children per provider! It IS a danger to health! It most CERTAINLY is a danger to the children! Two extra children CAN make a big difference – as a former child care provider, I know this! As someone with COMMON SENSE, I know this! And no, they shouldn't have been given any notice where the safety and health of children are concerned. If someone calls ACS and someone has their children taken away because they are ind anger, they don't receive warning. This is not a restaurant, this is a child care facility. I am so angered by their stupidity and lack of care and tact.
    Gosh, I know where I will never send my (not even existent at this time) children, even if they DO re-open!

I don’t care about million basements aroudnt hsi facility, I don’t care about competitors. I know just one thing: MY SON WAS HAPPY IN THIS FACILITY, AND I WAS HAPPY SEEING CLEAN ROOMS, HUGE HALL IN THE BASEMENT, DANCING LESSONS, E.T.C. Yes – daycare is just another kind of business. This is just one question:” How do you run this business. You can run it in stinky basement or, you can run it in huge clean building.

        The Risk? Do you understand what qualifications are? Do you know what the difference is between a trained professional and just any regular person? We put people through YEARS of training before we allow them to look over our children. It can mean the difference between life and death. Just because something didn’t happen doesn’t mean it couldn’t have?

        What if one of the kids stuck something up their nose that wasn’t obvious from a surface inspection? An untrained person might simply presume a child is misbehaving or throwing a tantrum instead of being in true distress. What about CPR? What if a kid is choking or having an allergic reaction? When people are trained they know what to do and they react on instinct to do what’s necessary. They don’t need to look it up, they don’t need to ask what to do, they just do it.

        Just because your kid was happy doesn’t mean he was safe. If you put a 4 year old in front of a tv screen he’ll happily sit there and watch tv all day. That doesn’t mean he’s learning something, it doesn’t mean he’s safe from harm. What you saw was an illusion. Boris Rey is a clown and a trickster, allegedly. If the things he’s alleged of perpetrating are true he’s a criminal.

        What kind of happiness is more important to you? The illusion, or the truth? You can just as happy at a daycare center with a legal staff and you know it.

          What is the risk? let me see .. your kids life. … Who do you sue if something goes wrong. They tried to hire UNTRAINED staff to save money and cut corners. We are lucky that we have rules and regulations in America. The owners should be arrested on criminal charges and they owe REFUNDS. So far NO ONE got a refund

    I know you are reading this post.

    When do you plan to issue to all of us parents refunds for unused 2-3 weeks as you have promised to us in letters which we received.

    We already enrolled our kids at other day care and they informed us that they are not run by former “маникюрша” and all of them are actually licensed and have every staff folder with their background and medical records. Also they have certifications or licenses. They charge me same tuition of $600 per child.

    I had easy time to come to their day care without appointment and nobody had walkie talkie radios or locked door as you used to do it.

    GIVE US MONEY BACK!

That's what they are hoping for – that the parents will finally give up hoping and waiting for their money and forget about this. Just like all the parents who quit RC before. WHAT ABOUT CALLING CHANNEL 12 and ORGANIZING A RALLY IN FRONT OF THE RC WITH ALL THE SUPPORTING DOCUMENTATION FROM DOH TO ALL THE PARENTS WHO STILL THINK IT'S ALL ABOUT COMPETITORS, AND HUGE SLOGANS “GIVE US OUR MONEY BACK!” and “DOH CLOSE THEM UP FOREVER!” or “STOP MAKING BUSINESS ON OUR KIDS!”

    There's no confusion about Ed. director. When they opened in August in their new location, they had someone by the name SUSAN who appears in the picture next to Maryana and Ira on Royal Crown Facebook page. Parents who visited day care in August -September 2009 might still remember this lady in her 40-50s with long dark hair always smoking outside with Boris and talking about paperwork and license issues. Ira and Boris bragged around to all the parents that SUSAN used to work in DOH and DOE for over 20 years and has her connections. As soon as they got their paperwork from the DOH, she was never seen again. I would not be surprised that it was her who “was hired but never showed up” according to their layer. BTW have anyone seen any hiring ads from RC in those months for an educational director? I bet not.

    How do we get together and sue RC for breach of contract and not delivering promised services. We had to take days off from work to take care of our own kids to find new day cares. How do we sue RC?

    I loved this Day Care. My son always came home clean, happy. I saw the development in him. They educated him. Day care was clean every time I came there. We were very upset when we heard that day care was closed. We were to forced to find an alternative and were recommended Bambi Day Care. To tell you the truth, it was the worst day care I saw. The kids were always by themselves, many times I came and I saw my son with a full and smelly diaper that hasn't been changed for hours. It never happened in Royal Crown. I hope, that they will reopen one day.

    I just learned from my reputable sources. Ira and Boris sold this day care to another person. It will be re-opened in 1-2 months after sale goes through and it will be under different name.

    News 12 reported today that 6 day cares were closed as part of a bribery ring. The day cares shown on the report were on Banner Avenue- very close to Royal Crown. Unfortunatly, I wouldn't be surprised if they were some how connected. This whole mess is disgraceful. Innocent (working) families are getting affected by this greed.
